By accessing and using Client's Desk, you accept and agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this service.

These terms constitute a legally binding agreement between you and Yotha Makpichai regarding your use of the Service.

2. Description of Service

Client's Desk is a professional project management portal provided by Yotha Makpichai. The service includes:

  • Project tracking and management tools
  • Secure communication channels
  • Document sharing and collaboration features
  • Progress monitoring and reporting
  • Client-provider relationship management

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice.

3. User Account

To access certain features, you must create an account through LINE Login or other provided authentication methods. You agree to:

  • Provide accurate, current, and complete registration information
  • Maintain and update your information to keep it accurate
  • Maintain the security and confidentiality of your credentials
  • Notify us immediately of any unauthorized access or use
  • Accept full responsibility for all activities under your account

4. Privacy and Data Protection

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference.

In compliance with the Thailand Personal Data Protection Act B.E. 2562 (PDPA), we are committed to protecting your personal data and ensuring transparent data processing practices.

We collect and process personal data only as necessary to provide our services, including:

  • Account information (name, email, LINE profile)
  • Project-related data and communications
  • Usage data for service improvement
  • Technical data for security and functionality

6. User Conduct

You agree not to use the Service to:

  • Violate any applicable local, national, or international laws
  • Infringe upon the intellectual property rights of others
  • Transmit harmful, offensive, or malicious content
  • Attempt to gain unauthorized access to any systems
  • Interfere with or disrupt the Service or its infrastructure

7. Intellectual Property

All content, features, functionality, and design elements of the Service are the exclusive property of Yotha Makpichai and are protected by Thai and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose. This license does not include the right to:

  • Modify or copy Service materials
  • Use materials for commercial purposes without authorization
  • Reverse engineer any software components
  • Remove any proprietary notices or labels

8. Disclaimer

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Defects will be corrected in a timely manner
  • The Service is free of viruses or harmful components
  • The results of using the Service will meet your requirements

9. Limitation of Liability

To the fullest extent permitted by applicable law, Yotha Makpichai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, data, or business opportunities
  • Service interruption or data loss
  • Unauthorized access to your data
  • Any conduct or content of third parties

Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including but not limited to:

  • Breach of these Terms of Service
  • Violation of applicable laws or regulations
  • Conduct that may harm other users or the Service
  • Extended period of inactivity

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms which should survive termination shall survive.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page. We will notify you of material changes through the Service or via email.

Your continued use of the Service after any changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Thailand.
